Access to this Web Site is subject to the terms and conditions set forth below. Your use of the Web Site signifies your acceptance of this agreement. If you do not agree to comply with this agreement, please do not use the Web Site.

Monster Event Hire reserves the right to make changes in the programs, policies, products and services described in this Web Site at any time without notice. A user who uses, or makes decisions based on information contained in this Web Site does so at the user’s own risk. By accessing this Web Site, the user agrees to hold Monster and its affiliates harmless against any claims for damages arising from any decisions that the user makes based on such information.

Limitation of Liability

Under no circumstances shall Monster Event Hire and/or its subsidiaries be liable for any damages, direct, special, incidental, consequential, punitive or exemplary or otherwise, that result from the use of, or the inability to use, the materials on this Web Site, even if Monster Event Hire or an authorised representative has been advised of the possibility of such damages.

As the Web Site is operated by Monster Event Hire from within the uk. This agreement shall be governed by and enforced in accordance with the European laws. If a court of competent jurisdiction finds any part of this agreement void or unenforceable, the remainder should be enforced and the court should use its authority to amend it in order to fulfil the stated purposes of this agreement to the fullest extent permitted by law.

 

1.              Little Monsters Event Hire CONTRACT TERMS AND CONDITIONS OF HIRE

(If the Hirer is in any doubt as to the meaning of the following, a representative from Little Monsters Event Hire should be consulted before signing).

1.A- THE HIRER will, during the period of the hiring, be fully responsible for the supervision of the equipment (unless supervision is provided by Little Monsters Event Hire), its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity, including proper supervision of children to ensure children under school age use the equipment separately to older children or adults. The Hirer acknowledges that he has read and understands any relevant operating and safety instructions supplied with the equipment. Little Monsters Event Hire excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract.

1.B- IN ALL HIRING CONTRACTS, any accessories or equipment that has been damaged or lost during the period of hire and in such circumstances the client will be responsible for any repairs/replacements. The Hirer shall indemnify Little Monsters Event Hire for the full cost of repair of any damage done to any equipment howsoever arising, which may occur during the period of the hiring because of the hiring, the client in no way should modify the equipment hired.

1.C -THE HIRER shall not use the equipment for any purpose other than that described in the hiring agreement, and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way, nor allow anyone onto the equipment wearing shoes, spectacles, carrying sharp objects, key-rings, metal studded clothing or any other similar items which could cause damage to others or the equipment. No food or drink is to be consumed on the equipment. The hirer should not use the equipment outside in the event of high winds or wet conditions, must locate the equipment on flat grassed ground and satisfy himself that there are not any sharp objects on the ground which may damage the equipment. The unit must always also be suitably anchored.

1.D- THE HIRER is responsible for ensuring that adequate safety barriers and notices are fitted around equipment if required. All equipment must be used in accordance with the HSE- BSEN 14960:2019, all operating instructions issued by Little Monsters Event Hire and in a suitable safe environment. Any equipment hired for use on licensed premises shall be operated in a fenced off, glass free area. Notices indicating that the area is a GLASS FREE ZONE will also be required.

The proposed operating site for the equipment is clear of any obstacles that may prove to be a hazard for the safe operation of the equipment and clear of any underground services (gas/electricity /water). Little monsters cannot be held responsible for any damage caused to underground services by the erection of any supplied equipment.

1.E- THE HIRER is required to provide access to a working and tested 240-volt 13amp power supply within 20 metres of the site. Each separate inflatable booked will require its own connection from the inflatable to the 240-volt 13amp wall socket (per fan ).

1.F- THE HIRER will provide the following site conditions. A level site for all equipment supplied, a minimum access width of 36 inches, ensure that the site is free from all debris, sharp objects, animal waste and within 50 metres of the delivery vehicle. If the site is outside of this distance, the hirer will provide an adult person to assist in the setting up and packing away of all equipment. If no person is available at the event, an additional charge of £50 may be levied against the bond at the discretion of Little Monsters Event Hire.

1.G – NO COLOURED DYES TO BE USED ON OR AROUND THE INFLATABLE, i.e  colour runs, for company, corporate or private hire

1.H -THE HIRER shall be deemed to have inspected the equipment, (accessories and trailer(s) if supplied) and to have agreed that it is supplied in good condition unless he brings to the attention of Little Monsters Event Hire within two hours of coming in to possession of the equipment any faults noted by the Hirer. Any fault not reported within this time will be deemed to be the responsibility of the hirer.

1.I -FOR EQUIPMENT delivered to site, any delay with regards to meeting the client after the contracted arrival time will be charged at an additional £10 per fifteen minutes waiting time incurred. This will be rounded up to the nearest fifteen-minute time period.

1.J- PUBLIC LIABILITY INSURANCE is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol.

1.K -IF THE HIRER wishes to cancel the booking for whatever reason, the following cancellation charges will become payable.
All hires are subject to a booking fee of at least 25% This covers all works for admin, works done before your event, e-mails, call’s, risk assessments, method statements, invoicing ect (booking fee is non-refundable whatever the reason, as this covers all admin).
Within 8 weeks prior to the event date 50% of the contract total (unless a government lock down is issued)
Within 4 weeks prior to the event date 75% of the contract total (unless a government lock down is issued)
Within 2 weeks prior to the event date 100% of the contract total (unless a government lock down is issued)
if cancelled during this time, a loss of the whole amount of the hire fee.
All cancellations or changes in booking must be notified in writing and will only be accepted from the franking date of the envelope upon receipt at our offices.

1.L- IN THE EVENT of an accident occurring, full written details must be recorded including, name and address of injured party, circumstances of accident, date and place of incident and a copy of the report to be sent to Little Monsters Event Hire, also to follow gdpr rules.

1.M -AT THE END of the hiring the Hirer shall be responsible for leaving the equipment in a clean and tidy condition otherwise Little Monsters Event Hire shall be at liberty to make an additional charge. If the Hirer fails to return the equipment in a clean and tidy condition Little Monsters Event Hire are entitled to levy a further charge of £25.00 per unit for the cleaning and servicing of the equipment.

1.N- IN THE EVENT of the equipment or any part thereof being rendered unfit for the use for which it has been hired, Little Monsters Event Hire shall not be liable to the Hirer for any resulting loss or damage whatsoever. Any refund offered for unusable equipment will be entirely at the discretion of Little Monsters Event Hire and will be made in writing before any payment will be made.

1.O -Little monsters cannot be held responsible for the weather.

1.pp ALL INFLATABLES MUST BE PUT ONTO A GRASSED AREA (unless indoors)- ON ARRIVAL IF THERE IS NO GRASS WE WOULD NOT BE ABLE TO PROCEED WITH THE BOOKING AND NO REFUND WILL BE GIVEN.

1.P- Generators, due to the use of petrol and heat from the exhaust we will not be held responsible for grass damage whatsoever.

1.Q Lighting: It is the responsibility of the Client, to ensure that there is adequate lighting throughout the event, to enable the safe use of the equipment otherwise the equipment will have to be shut down if the operator cannot see the controls due to safety,  In such a case no refund will be given.

Terms of Hire

Definitions
1.1 The “Client” means the person/s, organization or company booking the equipment, act or entertainment with the “Company”.

1.2 The “Company” means Little Monsters Event Hire.

1.3 ‘Dry’ hire is the hire of equipment for the ‘client’ to operate and supervise themselves.

1.4 ‘Wet’ hire is the hire of equipment or entertainment accompanied by a representative of the ‘company’ to supervise use of the booked equipment or entertainment.

Bookings
2.1 All equipment remains the property of the company always.

2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or booking fee paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our contract terms and conditions of hire.

2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.

Prices, booking fee & Balance Payments
3.1 All hires are subject to a booking fee of at least 25% (booking fee is non-refundable). See 1.K

3.2 The balance to be paid in full and cleared 14 days prior to the event start date.

3.4 Advertised prices are subject to change without prior notification.

3.5 The company reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.

3.6 All prices are subject to VAT at the current rate.

3.7 Little monsters cannot be held responsible for bad weather, no refunds are given for bad weather.

Cancellations
4.1 Any cancelled order is subject to the following cancellation charges Please see contract for terms

Equipment
5.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

5.2 All sizes quoted are approximate

5.3 All goods remain the property of the company always.

5.4 The company reserve the right to amend or alter any product specifications without prior notice.

 

Site Location, Facilities & Conduct

6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.

6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs, hard standing (unless indoors) or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.3 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves, or the safety of the hired equipment. At no time will any level of abuse against our staff be tolerated. In all such cases no refund will be given and full

Contracted fees will be due to the company.

6.5 Lighting:  It is the responsibility of the Client, to ensure that there is adequate lighting throughout the event, to enable the safe use of the equipment otherwise the equipment will have to be shut down if the operator cannot see the controls, In all such cases no refund will be given and full Contracted fees will be due to the company.

6.6- WEATHER- ALSO REFER TO RISK ASSESSMENT- All weather to be checked at the time of event by little monsters’ staff and considered prior to erection of structure, not to be used in winds over 24mph. n/a to indoor hires, all equipment has to be shut down if winds pick up above 24mph during event, this is in guidance with HSE rulings.

 

Liability & Insurance
7.1 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.

7.2 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment, this also applies to any staffed equipment that little monsters is manning, if their instructions are not carried out correctly.

The proposed operating site for the equipment is clear of any obstacles that may prove to be a hazard for the safe operation of the equipment and clear of any underground services (gas/electricity /water). Little monsters cannot be held responsible for any damage caused to underground services by the erection of any supplied equipment

 

Staffing of Equipment

  1. If Little Monsters are staffing any Equipment, running over 4 hours, staff will be required to take a break of 15 minutes, too half hour, depends on times running.

 

Parking

9 . Parking to be provided by the Client

weather –

We at monster event hire, will provided you with a wind speed measurement device (an Anemometer) for the purposes of safeguarding against inflatable use in high winds.

The maximum wind speed in which an inflatable can be used is 38 km/h (Force 5 on the Beaufort Scale) / 24 mph.

You will been provided a simple demonstration that comprehensively covers the use and operation of the Anemometer.

You understand it is your responsibility to be aware of changing wind conditions and record the wind speed in the immediate vicinity of the inflatable’s location. Should the recorded wind speed approach 38 km/h (Force 5 on the Beaufort Scale) / 24 mph or higher, you MUST quickly and safely evacuate the users and the inflatable device turned off.

Using the instructions demonstrated to operate the Anemometer, wind speed recordings are required to be completed every 30 minutes (or more frequently if there is any indication of wind speed increasing) by a competent person (aged 18+) supervising the use of the inflatable device.

Following the demonstration, the first recording has been made for you by the operator.

Indication that wind speed is increasing could be (but are not limited to): Wind is raising dust and loose paper, small branches are moved, small trees in leaf begin to sway.

As stated above, if the recorded speed is 38 km/h (Force 5 on the Beaufort Scale) / 24 mph or above, then all users should be evacuated from the inflatable as quickly and safely as possible with the inflatable then being turned off.

The inflatable should not be turned on until wind speeds have been consecutively and consistently recorded at less than 20mph for 30 minutes, taken at 5-minute intervals for the 30-minute duration.

If at any time any recorded wind speed is higher than 17mph then recordings must increase in frequency to every 5 minutes for a period of 30 minutes. This frequency may only return to every 30 minutes when there have been recordings consistently below 18mph for the entire 30-minute period and each recording is below 18mph.

If any time you are unable to take a wind recording for any reason, inflatable use must cease and desist with the inflatable being powered off after all users have been evacuated quickly and safely.

If at any time the Anemometer ceases to function, please contact us immediately for advice.

This sheet is to be used for recording the wind speed at previously stated intervals of frequency. The time of each recording must also be noted.

You understand it is your responsibility to carry out and record these wind recordings at regular intervals, and to carry out the safe and quick evacuation, should the wind conditions approach or reach 38 km/h (Force 5 on the Beaufort Scale) / 24 mph.
